These Terms of Service (“Terms”) govern your use of Noon (“the Service”). By creating an account, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use Noon. By registering, you confirm that the age and other information you provide are accurate.
2. Account conduct
You agree to use the Service respectfully, provide truthful information in your profile, and not impersonate another person or misrepresent your identity or age.
3. Reporting and moderation
Users can report other accounts for suspected violations, including fake profiles. Reports are reviewed by our moderation team.
4. Account suspension and termination
The administration reserves the right to freeze or permanently delete any account suspected of violating these Terms or the platform's community rules, or found to have misrepresented its age, at its own discretion and without prior notice.
5. Disclaimer of liability
Noon is an introductory platform intended to help users arrange initial contact with one another. We are not responsible for the conduct of any user, whether an interaction takes place within the Service or in person, and you agree to interact with, meet, and communicate with other users entirely at your own risk. We do not verify and do not guarantee the accuracy of information or profiles provided by users.
6. Limitation of liability
To the maximum extent permitted by applicable law, Noon and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including damages resulting from interactions with other users. Nothing in these Terms limits liability that cannot be excluded under mandatory Austrian or EU consumer protection law.
7. Data protection and user rights
In compliance with the EU General Data Protection Regulation (GDPR) and applicable Austrian data protection law, you have the right to access, correct, or request the complete deletion of your personal data at any time. You can delete your account and all associated data directly within the app's settings, or by contacting us using the details in Section 12. We keep your data only for as long as necessary to provide the Service and to meet our legal obligations, and we do not sell your personal data to third parties.
8. Intellectual property
The Noon name, logo, and the Service's design and software belong to its operators and may not be copied or reused without prior written permission. You retain ownership of the content you submit (such as photos and profile text) and grant us only the limited license needed to display and operate it as part of the Service.
9. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of Austria. Any disputes arising from the use of the Service will be subject to the exclusive jurisdiction of the competent courts in Vienna, Austria, except where mandatory consumer protection law provides otherwise.
11. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision will be read as modified to the minimum extent necessary to make it valid.
